The Growing Family Online Privacy Statement
(En Français)
Effective Date: February 26, 2007
Introduction
Consumer privacy is of great concern and a top priority for Growing Family. Protecting the privacy and confidentiality of your personal information has always been a fundamental principle in our relationship with you.
This Privacy Statement applies to any web site where this Privacy Statement is posted, including www.growingfamily.com, www.growingfamilyclub.com, and www.firstfoto.com, and does not apply to any other information collected by Growing Family through any other means. It tells you about the information we collect from visitors to these sites and how we use that information.
If you would like additional information about Growing Family's commitment to privacy, you should refer to our Privacy Commitment to the Protection of Customer Information.
Types of Information We Collect
Growing Family collects both "personally identifiable information" and "non-personally identifiable information" from or about users of its web sites.
Personally Identifiable Information
Growing Family collects several types of information that may identify a particular individual ("personally identifiable information"). We collect personally identifiable information when you provide it to us through your use of one of our web sites, such as by registering to join the Growing Family Club, by ordering photos from First Foto, or by sending questions or comments to us via any of our web sites. The types of personally identifiable information we collect include name, postal address, e-mail address, and telephone number. We may also collect other types of personally-identifiable information, such as gender, age, number of children, children's birth dates or due dates, and children's first names. Please review our policy, below, with respect to children's privacy.
Non-Personally Identifiable Information
Non-personally identifiable information is anonymous information that cannot be associated with a specific individual. The types of non-personally identifiable information that we collect (either directly, through the use of "cookies," or through the use of a third-party tracking system) include the IP address of the computer making the request. Usually, this IP address is not associated with your personal computer, but with a computer used by the portal through which you accessed the Internet, such as your Internet Service Provider or company network. IP addresses are not linked to personally identifiable information. A "cookie" is a piece of information that a web site sends to your computer while you are viewing the web site to remember who you are without personally identifying you.
The Growing Family system also gathers information about the areas users visit on the Growing Family site and about the links that may be selected from within the site to other areas of the World Wide Web or elsewhere online. Growing Family uses such information in the aggregate to understand how users as a group use the services and resources provided on the site. This way, the company knows which areas of its site are most popular, which areas need development, and what technologies are being used so that Growing Family may continually improve its site and provide users with a positive online experience.
Growing Family may share this non-personally identifiable information with its suppliers and other third parties for trend analysis and other statistical purposes. This information is not linked to any personally identifiable information that can identify any individual person.
How We Use Personally-Identifiable Information
We use personally-identifiable information to respond to your requests for information, process your enrollment in the Growing Family Club, and charge and fulfill orders that you place through any of our web sites, including First Foto orders and WebNursery requests. We also use personally-identifiable information to better understand and analyze your responses, needs, and preferences, and to develop, enhance, market and provide products and services to meet those needs. In addition, information collected may also be used for the specified purposes of Growing Family business units as outlined in our Privacy Commitment to the Protection of Customer Information.
In the course of processing a transaction with you, such as fulfilling an online order, we may share some of your personally identifiable information with certain entities that we have contracted to process and manage transactions, data management, and communications on our behalf. Such functions include package deliveries and credit card payment processing. We require the companies who have access to this personally identifiable information to protect the information by, for example, using the information only to provide the services we have asked them to provide.
We may use personally-identifiable information to communicate information and special offers from Growing Family and the Growing Family Club. Growing Family respects the privacy of its customers and Growing Family Club members when promoting products and services. Growing Family may share your personally-identifiable information from time to time with select third-party product and service providers with whom we have entered into a marketing relationship as part of the Growing Family Club so that these entities can inform you about their products, services, rewards and special offers If you would like to request that we not share your information with these third parties for marketing purposes, you may e-mail or write to us at any of the addresses below.
We may disclose personally identifiable information collected through our web sites if, in our opinion, such disclosure is required to comply with legal process, for example, in response to a court order or subpoena. We may also disclose such information in response to a law enforcement agency's request, or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, to comply with legal requirements, or as otherwise required by law.
Children's Privacy

If you provide us with the first name, birth date, and/or due date of your baby, such as when you make photos or other information about your baby available to others online, we provide you the option to password-protect any such information about your baby. Whether or not you elect to password-protect this information, if you allow friends and family to view your baby's photo or birth information through one of our web sites, we display no more than the baby's first name, middle name, and last initial. If you choose to password-protect your baby's photos or any other information about your baby, such information can only be viewed by those with whom you have shared the password.
Links to Third Party Sites
Growing Family's web sites may have links to the sites of other companies. Growing Family is not responsible for the privacy practices of those companies, nor do we monitor or control the information they collect when you access or use their web sites. Since their treatment of personally identifiable information may differ from ours, we encourage you to learn about the privacy policies of those companies.
